Choosing off-road diesel makes sense when you have a use that is exempt from diesel fuel taxes. This fuel is not different from on-road diesel other than being dyed red. It is dyed red so that you can tell which you are using and so that authorities can determine if you are using it unlawfully.
Since the fine associated with putting off-road diesel into highway vehicles is either $10/gallon or $1,000 per violation (per tank), whichever is greater, so it far better to go ahead and pay the required highway taxes rather than run the risk of paying this high fine. Since repeated violations result in an increase to the amount of $1,000 over the previous violation, you could shell out thousands of dollars if you continue to make this mistake. You can use off-road diesel in tractors and other farm equipment as long as they are located within 25 miles of the registered address. Public school districts, government agencies and nonprofit educational organizations are also exempt from diesel tax and can use off-road diesel in any vehicle.
